Article 1. Company

 

MAIORI is a company registered in the Hong Kong Companies Registry under number 360672888-000-10-13-5.

Mailing address: Unit 1005, Westley Square, 48 Hoi Yuen Road, Kwun Tong, Kowloon, Hong Kong.

 

Article 2. General Matters

 

These General Sales Conditions of the Maiori Company define the rights and obligations of the parties within the context of the sale of products by Maiori via the www.maiori.com website.

The client declares that he/she has acquainted him/herself with these General Sales Conditions, at the time the order is placed, and that he/she accepts them unconditionally. 

Any order made on this site is governed by these conditions.

 

Article 3. Product Features and Description

 

The products in question are those that appear in the catalogue published on the maiori.com website and presented in the product sheets.

The product photographs are not contractually binding and shall under no circumstances incur liability to Maiori.

The products are offered as long as supplies are available in our warehouse.

In the event of total or partial unavailability of a product after the placement of an order, the client will be informed by e-mail of the delivery of a partial order or of the cancellation of the order.

Pursuant to the provisions of Article L 121-20-3 of the Consumer Code, in the event of product or service unavailability, the client shall then have the option to:

  • either receive delivery of a product of equivalent quality and price, subject to availability;
  • or receive reimbursement for the price of the product ordered within 30 days of a request.

The delivery costs of a new product will be assumed by Maoiri.

 

Article 4. Orders

 

Maiori confirms the order to the client via the e-mail address indicated by the client.

The sale is deemed to have been concluded upon confirmation of the order.

All of the data provided and the recorded confirmation shall serve as proof of the transaction.

Maiori reserves the right to cancel any order made by a client with whom there is a dispute regarding payment of a previous order.

The client shall be held liable for the information provided and Maiori shall under no circumstances be held liable in the event of an error in the wording of the recipient’s contact information, which would render the delivery impossible.

 

Article 5. Delivery

 

The products will be delivered to the address indicated by the client during the order process within 48 business hours of the time of confirmation of the order and receipt of payment.

For deliveries outside of continental France, the client undertakes to pay all taxes due upon the importation of products, customs duties, value added tax, and all other taxes due pursuant to the laws of the order recipient’s country. The seller shall not be held liable if the taxes are not paid by the client.

Delivery is made by our partner, SC-2, per the following rates:

The client shall, in particular, ensure that he/she verifies the proper operation of the product and read the instruction manual that is provided to him/her.

Should the product present an apparent defect, the buyer may return the product under the conditions stipulated below.

The buyer has the obligation to verify the contents of his/her parcel upon arrival and has 72 hours to file a claim with the carrier in the event of missing product or damage.

In the event of a reimbursement or exchange, the client must return the product in its original packaging.

 

Article 6. Withdrawal

 

Article L120-20 of the Consumer Code states:

“The consumer has seven clear days in which to exercise his right of withdrawal without giving a reason therefor or incurring a penalty, with the exception, where applicable, of the cost of returning the goods.”In the event of exchange or reimbursement, you may send the new article(s) in its (their) original packaging, as well as any accessories, instruction manuals and other documentation to the following address:

Any reimbursement to the client shall be made via bank transfer within 15 days of the date of receipt and quality control of the products by SC2. All of the amounts paid by the client, other than return costs, shall be reimbursed.

Maiori Objects of Design does not accept returns of products on sale or provided under exceptional offer conditions. Outside of the European Community, returned products must be flagged as being "non-compliant". Maiori Objects of Design shall not bear the costs of taxes and customs duties associated with product returns.

Reimbursement Rates / Exchange Return Costs:

  • France: €10
  • UK: £12
  • Other countries: €15

 

Article 7. Prices

 

Product prices are expressed in euros and are not inclusive of shipping costs.

The final price is that indicated on the order confirmation. It includes VAT for France and the countries of the European Community. It also includes handling and packaging. The price of shipping is indicated upon order confirmation.

The shipping rates are provided in the appendices.

For clients residing outside of the territory of the European Union and in the French Overseas Departments and Territories, it is stipulated that the price displayed on the Site shall be invoiced after deduction of the VAT. The prices must be DDU (“Delivery Duty Unpaid”), given that it is not materially possible for Maiori to convey to clients exact information on the total costs pertaining to applicable customs duties and formalities, as well as applicable import duties in the country to which the delivery is requested.

The client(s) acknowledge and agree that payment of these costs, where necessary upon the entry of the products ordered in the delivery territory, shall be the sole responsibility of the client(s).

 

Article 8. Payment

 

Payment is made by VISA or MASTERCARD credit card via PayPal.

The invoiced price is the one indicated on the order confirmation.

 

Article 9. Disputes

 

These General Sales Conditions, written in French, will be executed and interpreted pursuant to French law.

In the event of dispute, the client will first speak to Maiori Objects of Design in order to seek to achieve an amicable solution.
Failing that, French courts shall have jurisdiction.

 

Article 10. Guarantee

 

The products provided by the seller are covered by the legal guarantee as provided for in Articles 1641 and following articles of the Civil Code.

In the event of non-compliance of a product sold, it may be returned to the seller in its original packaging, who will take it back, exchange it or reimburse it.

Products that have been modified, repaired, integrated or added by the client or by any other person not authorised to do so by the supplier of said product are excluded from the guarantee. The guarantee shall not cover patent defects, nor shall it cover the costs of products or services damaged during shipping or improper use.

 

Article L211-4 of the French Consumer Code

The seller is required to deliver a product which conforms to the contract and is held liable for any lack of conformity which exists upon delivery. The seller is also held liable for any lack of conformity caused by the packaging or the assembly instructions, or the installation if he assumed responsibility therefor or had it carried out under his responsibility.

 

Article L211-5 of the Consumer Code

 

To conform to the contract, the product must:

 

1. Be suitable for the purpose usually associated with such a product and, if applicable:

 

  • correspond to the description given by the seller and have the features that the seller presented to the buyer in the form of a sample or model;
  • have the features that a buyer might reasonably expect it to have considering the public statements made by the seller, the producer or his representative, including advertising and labelling;

 

2. Or have the features defined by mutual agreement between the parties or be suitable for any special requirement of the buyer which was made known to the seller and which the latter agreed to.

 

Article L211-12 of the Consumer Code 

Action resulting from lack of conformity lapses two years after delivery of the product.

 

Article 1641 of the French Civil Code 

A seller is bound to a warranty on account of the latent defects of the thing sold which render it unfit for the use for which it was intended, or which so impair that use that the buyer would not have acquired it, or would only have given a lesser price for it, had he known of them.

 

Article 1648-1 of the Civil Code

The action resulting from redhibitory vices must be brought by the buyer within a period of two years following the discovery of the vice.

Maiori shall under no circumstances be held liable for failure to comply with regulatory and legislative provisions in effect in the destination country. Maiori’s liability is strictly limited to the value of the product being considered, without any possibility of recourse against the product brand or manufacturer.

Maiori shall not be held liable for damages of any kind, whether material, immaterial or injury, that may result from malfunction or improper use of the products.

 

Article 11. Personal Data

 

Maiori undertakes to maintain the confidentiality of all personal data conveyed by clients via the website and to process them in accordance with the French Data Processing and Civil Liberties Law of 6 January 1978.

Pursuant to the French Data Processing and Civil Liberties Law of 6 January 1978, the client may, at any time, exercise his/her right to access their file, his/her right to object and his/her right to correct or delete information concerning him/her by sending a request (indicating the e-mail address, last name, first name, mailing address):

Article 12. Modifications to the General Sales Conditions

 

Maoiri reserves the right to modify these General Sales Conditions.
